1. Agreement to Terms

By accessing or using Fablino ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Fablino is an AI-powered platform that generates personalized stories for children. The Service includes:

  • Story generation with customizable themes and characters
  • Text-to-speech audio narration
  • Child profile management
  • Story library and favorites
  • Voice preferences and customization
  • Story Sagas (multi-chapter story continuations)
  • Referral program ("The Bedtime Buddy System")
  • Multilingual story generation (English, German, Spanish, Portuguese)

3. Age Requirement & Child Profiles

Account Holder Requirements

  • You must be at least 18 years old to create a Fablino account
  • You must be a parent, legal guardian, or authorized caregiver
  • You are responsible for all activity under your account

Child Profiles

  • Child profiles are for personalization only and do not grant account access to children
  • By creating child profiles, you certify that:
    • You are the parent or legal guardian of the children you add
    • You have the authority to provide their information
    • You consent to the use of their data as described in our Privacy Policy
  • Children do not receive accounts, passwords, or direct access to Fablino
  • You are responsible for supervising your children's use of stories generated by the Service

4. Subscription Tiers and Billing

Fablino Plan

  • €9.99/month (monthly billing only)
  • 180 audio minutes per month
  • Unlimited stories (subject to monthly audio minutes limit)
  • Fablino Voice narration
  • Up to 5 child profiles
  • Story Sagas (multi-chapter stories)
  • Background music
  • MP3 downloads
  • Story length: 3–15 minutes per story

"Unlimited stories" means no per-story count limit; usage is governed by the monthly audio minutes allowance. "Fablino Voice" is a descriptive label and does not reference specific third-party providers.

Billing

  • Subscriptions are billed monthly
  • Prices are displayed in EUR for EU customers and USD for US customers
  • Payment is processed through Stripe
  • Subscriptions auto-renew unless cancelled
  • 30-day money-back guarantee: if Fablino isn’t right for you, request a refund within 30 days of your first payment and we’ll refund it, no questions asked
  • Outside the 30-day money-back guarantee, partial months are not refunded, but you can cancel anytime and keep access until the end of your current billing period

Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • You retain access to paid features until the subscription expires
  • Cancelled subscriptions retain access until the end of the current billing period, after which story creation is paused

Subscription Terms

Your subscription begins immediately upon purchase. You will be billed monthly until you cancel. Cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree to use Fablino only for lawful purposes. You must NOT:

Prohibited Content

  • Generate stories with violent, sexual, or inappropriate content
  • Use the Service to harass, abuse, or harm others
  • Create stories that promote hatred, discrimination, or illegal activities
  • Attempt to generate content that infringes copyrights or trademarks

Prohibited Activities

  • Share your account credentials with others
  • Attempt to reverse engineer or hack the Service
  • Use automated tools to scrape or download content in bulk
  • Resell or redistribute generated stories commercially without permission
  • Interfere with or disrupt the Service
  • Bypass usage limits or restrictions

Content Moderation

  • All generated stories are subject to automated moderation
  • We reserve the right to review, flag, or remove inappropriate content
  • Repeated violations may result in account suspension or termination

6. Intellectual Property

Generated Stories

  • Stories generated by Fablino are created specifically for you
  • You retain personal, non-commercial rights to generated stories
  • Non-Commercial Use: You may share stories with family and friends, print them, or use them personally
  • Commercial Use: Selling, licensing, or commercially exploiting generated stories requires written permission
  • AI-generated content may not be eligible for copyright protection under current law

Service Content

  • Fablino, its logo, design, and features are protected by copyright and trademark laws
  • You may not copy, modify, or create derivative works of the Service
  • Theme templates, UI elements, and system prompts remain our property

User Content

  • You retain ownership of information you provide (child names, interests, customizations)
  • By using the Service, you grant us a license to use this information to generate stories
  • We may use aggregated, anonymized data to improve the Service

7. AI-Generated Content Disclaimer

  • Accuracy: Stories are generated by AI and may contain factual inaccuracies. Fablino does not guarantee the accuracy, completeness, or appropriateness of AI-generated content.
  • Variability: AI output may vary for similar inputs. Story quality depends on the information you provide.
  • Review: Always review stories before sharing them with children.
  • Entertainment Only: Stories are for entertainment purposes only and should not be relied upon for educational, medical, or professional advice.

8. Privacy and Data Use

Your use of the Service is subject to our Privacy Policy. We collect and use data as described therein. Children's data is handled in compliance with EU data protection law, including GDPR and applicable national laws. Fablino is operated by a Spanish entity (Fablino Technologies SL) and targets EU users. By using the Service, you consent to data processing as described in our policies.

9. Third-Party Services

Fablino uses third-party services including:

  • Supabase (authentication and database)
  • ElevenLabs (primary voice narration)
  • Amazon Polly (fallback voice narration)
  • OpenAI (story generation and secondary narration fallback)
  • Stripe (payment processing)

Your use of the Service is also subject to these third parties' terms of service.

10. Disclaimers and Limitations of Liability

Service "As Is"

The Service is provided "as is" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitations

  • We do not warrant that the Service will be uninterrupted, error-free, or secure
  • We do not guarantee the quality, accuracy, or appropriateness of generated content
  • Technical issues may result in data loss or service interruptions

Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FABLINO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, DATA, OR USE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS.

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Fablino, its affiliates, and service providers from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Violation of these Terms
  • Infringement of third-party rights
  • Misuse of generated content

12. Termination

By You

  • You may terminate your account at any time through account settings
  • Cancelling keeps your access until the end of the current billing period. Outside the 30-day money-back guarantee, partial months are not refunded

By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent activity
  • You abuse the Service or harass other users
  • We are required to do so by law

Effects of Termination

  • Your access to paid features ends immediately
  • Your data may be deleted after a grace period (see our Privacy Policy)
  • Some provisions of these Terms survive termination (liability, indemnification, etc.)

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Sending an email notification (for significant changes)

Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Dispute Resolution

Governing Law

These Terms are governed by the laws of Spain and the European Union, without regard to conflict of law provisions.

Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt informal resolution.

Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

15. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fablino.
  • Severability: If any provision of these Terms is found invalid, the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign these Terms. We may assign our rights and obligations to any successor or affiliate.
  • Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.

16. Special Provisions for Parents

Supervision

  • You are responsible for supervising your children's exposure to generated stories
  • Review stories before sharing them with children
  • Use parental discretion regarding content appropriateness

Content Concerns

  • If a generated story contains inappropriate content, please report it immediately
  • You can delete any story at any time
  • We continuously improve our content moderation systems

Data Rights

  • You have the right to access, modify, or delete your children's profiles at any time
  • Child profiles can be deleted independently of your account
